Talkaway Terms of Use and License Agreement

Last updated: October 29, 2026

These terms are an agreement between you and Talkaway (trading name), an individual sole proprietor based in Japan ("we", "us"), the developer of Talkaway. They cover the Talkaway app for Mac (including Talkaway Pro, together "the Software") and the website talkaway.app. By installing or using the Software, or by buying Pro, you agree to these terms. If you do not agree, do not use the Software.

1. License

  1. We grant you a personal, non-exclusive, non-transferable license to install and use the Software on Macs you own or control.
  2. Free. Talkaway can be used free of charge, with limits (for example 5,000 dictated words per week, 3 skins and a 20-word personal dictionary). Free may be used on one Mac.
  3. Pro. Pro is a one-time purchase that removes the Free limits and unlocks the features described on talkaway.app at the time of purchase. One purchase may be used on up to 3 Macs at the same time. To move Pro to another Mac, remove a Mac from your purchase in the app or through the link we email you.
  4. Pro does not expire. Updates to version 1.x are included. Future major versions may be offered as a paid upgrade.
  5. You may not share your purchase link, resell Pro, or let people outside your household use your purchase.

2. What Pro needs

3. Purchases

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

Prices are shown on talkaway.app and at checkout. Paddle calculates and collects any sales tax, VAT or consumption tax that applies in your country, and the total you pay is shown before you confirm. Your purchase is also subject to Paddle's Buyer Terms.

4. Refunds

You may get a full refund for any reason within 14 days of your purchase date, as described in our Refund Policy, which is part of these terms. This does not limit your statutory rights or your rights under Paddle's Buyer Terms and Refund Policy.

5. Beta versions

Versions labeled "beta" are pre-release software provided free of charge for testing. They may contain bugs, may change or lose features, and may stop working. Beta builds may not be signed with an Apple Developer ID or notarized by Apple; macOS will warn you when you first open them. Download the Software only from talkaway.app. During the beta, beta builds include Pro features free of charge until the end date built into each beta build and shown in Settings. After that date the beta build works as Free. Free use of Pro during the beta is not a purchase: it creates no license, it cannot be refunded, and it does not carry over to the official release. Beta versions are provided as is, to the extent permitted by law.

6. Updates

The Software checks for updates about once a day and can install them automatically; you can turn this off in Settings. We may provide updates, but we are not obliged to. Some updates may be needed to keep Pro activation working.

7. Things you may not do

  1. Share, sell or publish purchase links or activation certificates.
  2. Reverse engineer, decompile or modify the Software, or get around its license checks, except where the law allows it.
  3. Redistribute, rent or sublicense the Software, or host copies of it elsewhere.
  4. Use the Software to break the law or to record people without their permission.

8. Your content

What you dictate and type is yours. It is processed on your Mac and we do not receive it (see our Privacy Policy). Always check dictated text before you send or publish it.

9. System requirements

Mac with Apple silicon, macOS 26 or later, and Apple Intelligence turned on. Speech recognition and translation languages depend on macOS. Please try Free on your Mac before buying Pro.

10. No warranty

The Software is provided "as is". To the extent the law allows, we do not guarantee that transcription or text cleanup will be accurate, that the Software will be error-free, or that it will suit a particular purpose. Nothing in these terms limits rights you have under consumer law that cannot be waived.

11. Limitation of liability

To the extent the law allows, we are not liable for indirect or consequential damages, or for loss of data, profits or business, arising from use of the Software. Our total liability is limited to the amount you paid for the Software in the 12 months before the claim. This does not limit liability for our willful misconduct or gross negligence, or any liability that cannot be limited by law.

12. Ending this agreement

You can stop using the Software at any time by deleting it. If you seriously breach these terms, we may end your license and deactivate Pro after notifying you. Sections 7, 10, 11 and 13 continue after the agreement ends.

13. Governing law

These terms are governed by the laws of Japan. Disputes will be heard by the district court with jurisdiction over our place of business as the exclusive court of first instance. If you are a consumer, you keep the protection of the mandatory laws of the country where you live.

14. Changes

We may update these terms. The version shown when you bought Pro applies to that purchase. For other changes we will update the date above and, for material changes, mention them in the release notes.
